HENLEY, Senior Circuit Judge. In November 1989 Charles E. Hajek applied for disability insurance benefits and Supplemental Security Income under the Social Security Act. After Hajek requested and received a hearing, an administrative law Judge (ALJ) denied benefits. The Appeals Council denied review, so the ALJ's decision became the final decision of the Secretary of Health and Human Services (Secretary). Hajek then brought suit in federal court. The case was referred to a magistrate Judge, who recommended that the Secretary's decision be affirmed. After the district court adopted this recommendation, Hajek appealed to this court. We reverse and remand.
